KFM BROADCAST RHODES QUALITY BACK TO SCHOOL COMPETITION

TERMS AND CONDITIONS

  • The name of the Promotional Competition is Rhodes Quality KFM Back to School Competition (hereinafter the “Competition”).
  • The following terms and conditions apply exclusively to this Competition. Participation in the Competition constitutes the entrant’s acceptance of these terms and conditions.
  • By entering the Competition, Entrants acknowledge that the Competition will be managed in accordance with the provisions of the Consumer Protection Act. Entrants agree to do everything possible as may be reasonably requested by the Promoter and in accordance with the rules of this Competition to meet its obligations as required by any applicable South African law, including but not limited to supplying personal information as may be needed to process including but not limited to facilitate the awarding of the prize to the Entrant.
  • This Competition runs on Mid-Mornings with Tracey Lange from Monday, 19 January 2025 to Friday, 23 January 2025, 09:00 – 12:00 (“the Competition Period”).

  • Primedia (Pty) Ltd is responsible for the issue of Prizes in this Competition.
  • To enter:
    • Entrants are to WhatsApp the keyword “Rhodes”, their name and ID number to 082 945 0940.
    • If the station contacts them to participate, the entrant will go live on air and will have 30 seconds to name as many Rhodes Quality products as they can, that one can find in a school lunch box.
    • The winner is awarded R1000 for each correct answer.
    • The maximum amount which can be won per day is R10 000.
    • Entrants must include the Rhodes Quality brand name ahead of their answers to qualify for a correct answer, e.g. Rhodes Quality 100% apple juice.
  • The judge’s decision is final, and no further correspondence will be entered into.
  • The prize is not negotiable, and not transferrable.
  • This Competition is not open to any minor, a director, member, partner, employee, or agent of, or consultant to the Promoter and/or Primedia or any other person who directly or indirectly controls or is controlled by, the Promoter and/or Primedia, or a supplier of goods or services in connection with that Competition.
  • Prize Delivery takes place within 30 working days from the date of received documentation. The Primedia Prizes Department will notify winners of the required documents. Kfm 94.5 and Rhodes Quality Products will not be held responsible for any charges or costs incurred while participating in this Competition.
  • The Promoter is not liable for any technical failures affecting the participation and/or Prize redemption process of the Competition.
  • Kfm 94.5 and Rhodes Quality Products will not be held liable for entries not received for any reason whatsoever and will not be responsible for network connectivity or hardware issues experienced while participating.
  • The Promoter and/or its directors, members, partners and employees shall not be liable in any way whatsoever for any loss, damage or costs, howsoever arising, suffered by a winner of any of the prizes and/or its use in this Competition.
  • A Entrant will not be able to win this Competition if they have won a prize on 702, 947, CapeTalk and/or Kfm 94.5 within the past 90 days, whether on-air, online or via any of Primedia Broadcasting’s social media platforms.
  • If the winner chosen does not comply, their entry will be disqualified, and a new winner will be drawn.
  • In the event that a winner cannot be successfully contacted, is ineligible to accept the prize, or contravenes the terms and conditions of this Competition or of 702, 947, CapeTalk and/or Kfm 94.5, the prize will be forfeit.
  • Kfm 94.5 and Rhodes Quality Products reserve the right to cancel or amend the Competition and these terms and conditions without notice. Any changes to the Competition will be notified to Entrants as soon as possible by the promoter.
  • Employees of Rhodes Quality Products, Primedia Broadcasting and their immediate family and friends, are not permitted to enter the Competition.
  • By entering this Competition, a Entrant is indicating his/her agreement to be bound by these terms and conditions.

All parties shall take all reasonable steps to ensure that all Personal Information that is collected is complete, accurate, not misleading and updated.   • By your usage of this site, you agree to Primedia and the Promoter processing your personal information including but not limited to information about your age, gender, marital status, occupation, qualifications and/or household structure.

TERMS & CONDITIONS

1.1 The Promoters of this Competition are Pick n Pay Retailers Pty Ltd (“Pick n Pay”) (registration number:  1973/004739/07) a company incorporated in the Republic of South Africa and having its registered address  at 101 Rosmead Avenue, Kenilworth, 7708 and RFG Foods (Pty) Ltd (Registration number: 2012/074402/07)  a company incorporated in the Republic of South Africa and having its registered address at Pniel Road,  GrootDrakenstein, Western Cape, 7680 (“RFG”).RFG and Pick n Pay shall alternatively bereferred to as the  “Promoters”).

1.2 All persons entering the Pick n Pay and Rhodes Juice Smart Shopper Competition ("the promotional  Competition", alternatively “the Competition”) ("the Entrants") agree that the Competition rules as set out in these terms and conditions are binding on them. 2. IMPORTANT NOTICE 

2.1 These terms and conditions and Competition rules contain certain terms and conditions which appear in a similar text style to this clause and which: 

2.1.1 may limitthe risk orliability ofthe Promoter or a third party; and/or 

2.1.2 may create risk orliability forthe Entrant; and/or 

2.1.3 may compelthe Entrantto indemnify the Promoter or a third party; and/or 

2.1.4 serves as an acknowledgment of a fact by the Entrant. 

2.2 The Entrant's attention is drawn to these terms and conditions because they are important and should be carefully noted. 

2.3 The Entrant cannot be a juristic person and must be an individual. 

2.4 Nothing in these terms and conditions is intended to or must be understood to, unlawfully restrict, limit, or avoid any rights or obligations, as the case may be, created for either the Entrant or the Promoter in terms ofthe Consumer Protection Act, 68 of 2008 ("the CPA"). 

2.5 The Entrant acknowledges that by submitting his or her entry to the Competition he/or she has been  given an appropriate opportunity to first read these terms and conditions before entering and that he/or she understands and agrees to the terms and conditions. 

2.6 All Entrants to this promotional Competition participate entirely at their own risk. By reading and  accepting these terms and conditions, the Entrant gives consent to these risks and hereby  indemnifies and holds harmless the Promoters, RFG, Pick n Pay, and all entities in the Pick n Pay and  RFG group, their directors, employees, and agents of any liability about any damage, cost, injuries, and losses of whatever nature sustained as a result of their participation in the Competition and  related events and activities, save where such damage, cost, injuries, and losses are sustained as a  result of the gross negligence or willful misconduct of any indemnified party.

3.1 This promotional Competition opens at 00:01 on 5 January 2026 and closes at midnighton 9 February 2026. No entries received outside of the Competition period will be considered.

3.5.1 Entrants stand a chance to win 1 of 20 (one of twenty) PS5s and 65 inch TV’s (“the Prize”), with an  approximate total value of R20 500 (twenty thousand five hundred rand).

3.5.2 Prize details:

- Playstation 5 slim console digital no disc; and
- JVC5 65” QLED TV
- The Prize could vary to the one shown on the banner, subject to the Promoters’ discretion.  

3.5.3 There will be 20 (twenty) winners in total.

3.6 Prizes are not transferable, and no substitution or cash redemption of Prizes are permitted. The Prize will  not be handed/awarded to a third party, but only to the verified Winner(s) in accordance with the rules as  set out herein.

3.7 Except to the extent otherwise provided by law, the Promoters gives no warranties, representations, or  guarantees in respect of the Prize and shall not be liable for any defect or unsuitability once delivered.

3.8 The Promoters reserve the right, at its sole discretion, to substitute the prize with any other prize of  comparable commercial value for whatsoever reason.

3.9 Entrants may entertheCompetition asmany times as they wish provided that each entry is associated with  a separate qualifying purchase and smart shopper card swipe.

3.10 The Promoters shall not be liable for any damage, cost, injuries and losses sustained in relation to  the Competition and the Prize and its enjoyment. All risks associated with the Prize including losses  relating to fraud or unauthorised use shall transfer to the winner upon award. The winner indemnifies  the Promoters against any loss or damage which may be suffered by taking part in the Competition,  including any claims related to the Prizes.  

3.11 Prizes are nottransferable and may not be exchanged for cash or other prizes.

3.12 To qualify as an Entrantforthis promotionalCompetition,the Entrant:

3.12.1 must resident in SA and/or have the relevant permit to be in SA.

3.12.2 must provide correct and fullpersonal details, as required;

3.12.3 must be 18 years old or older;

3.12.4 must be in possession of a valid TV license;

3.12.5 cannot be a juristic entity and must be an individual; and

3.12.6 must be a registered Pick n Pay Smart Shopper, who has opted-in to receive communications.

3.13 The Promoters reserve the right to disqualify any Participant who enters including but not limited to using  false information by robotic, automated or like means.

3.14 The Promoters, Pick n Pay, any entity in the Pick n Pay Group or Company and RFG, their directors,  members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional Competition, or any other person who directly or indirectly controls or is controlled by the above-named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional Competition.

4. SELECTION OF WINNERS 

4.1 Winners will be selected within six weeks of the Competition closure date (this date is subject to change  without notice).

4.2 Entrants to whom prizes will be awarded will be selected through a random draw.

4.3 The draw will be overseen by an independent accountant or registered auditor or practicing attorney or  advocate, who will ensure that the Competition is conducted fairly and in compliance with Regulation 11  of the CPA. The name and contact details of the independent auditor/attorney/advocate will be made  available to any person on request.

4.4 Winners will be contacted via email or telephonically within six weeks oftheCompetition closure date (this  date is subject to change without notice). Pick n Pay and RFG reserves the right to disqualify a winner if  he/she does not respond to the email or telephone call within one week of winner selection, and/or if the  Entrant cannot provide proof that he/she meets the requirements as stipulated in clause 3.12 above. If an  Entrant is disqualified, the Promoters may randomly select a replacement winner from the Competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by  Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. Ifthe replacement winner fails to respond to Pick n Pay as required, then  the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will need to take place  immediately.

4.5 Once successfully contacted, the winner must claim the prize within 48 hours by:

4.5.1 Confirming the acceptance of the prize, either telephonically or in writing;

4.5.2 Providing a valid copy of his/her South African identity document for verification purposes of the  Promoters.

4.5.3 The prize will be delivered to the verified winner’s nominated address.

4.6 An eligible Winner may be required to provide proof of purchase, identity, address, including their full  name, contact number, and e-mail address, as well as any other information as may be required for the  Promoter or its agent to carry out prize delivery.

4.7 All risk and ownership of the prize shall pass to the Winner(s) on transfer/delivery.

4.8 Pick n Pay and RFG reserve the right to amend the terms and conditions as well as terminate the  Competition at any time. In the event of such termination, all Entrants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay,  RFG, its advertising agencies, advisors, suppliers, and nominated agents.

5. DATA PRIVACY 

5.1 Personal Information means information relating to an identifiable, living, natural person and where its  applicable, an identifiable, existing juristic person including but not limited to defined in the Protection of  Personal Information Act (“POPIA”).

5.2 The Entrants hereby consent to provide the Promoters with the relevant personal information required in  order to enter the Competition as well as allow the Promoter to share the personal information with the  designated third-parties.

6. GENERAL 

6.1 By entering the Competition following its terms, you are entering a promotional Competition for the  ConsumerProtection Act, 2008("CPA")and thepromotionalCompetition willbeconducted by therelevant  provisions of the CPA. Should you win a prize in the Competition, you undertake to expeditiously do all  things necessary to enable the Promoters/sponsor to comply with its obligations under the CPA including,  but not limited to (i) providing such personal information as may be required to facilitate handing over the  prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its  delivery.

6.2 The names of the prize winners will be published on the Pick n Pay and RFG Websites, subject to the winners’ consent.

6.3 Winners may be requested to take part in the Promoter's publicity campaigns or to allow their names and  likenesses to be used by the Promoter for promotional purposes. Winners are, however, entitled to decline  such requests.

6.4 The Promoters shall conduct the Competition, and the Promoters’ decision on any matter related to the Competition, including the selection of prize winners is final and no correspondence will be entered into.

Participants must ensure that their contact details submitted when entering are correct as these are the contact details that the Promoter will use to reach the winner. If a winner has given incorrect contact details, the Promoter reserves the right to select another winner in terms of the rules.

The prize: Participants stand a chance to win R5000 Shopping Vouchers (Five Thousand Rand) every 2 weeks during November 2025 and another for December 2025, with each participant eligible to win one voucher per month only.

The prize is not transferrable.

Winners will be randomly drawn once the Competition Period has ended. The draw will be overseen by an independent accountant or registered auditor or practicing attorney or advocate, who will ensure that the Competition is conducted fairly and in compliance with Regulation 11 of the Consumer Protection Act (Act No. 68 of 2008) (“the CPA”). The name and contact details of the independent auditor/attorney/advocate will be made available to any person on request.
